Major capital allowances win for taxpayer

The Court of Appeal has upheld SSE’s claim to capital allowances on over £200m of expenditure relating to the construction of a hydroelectric scheme in Glendoe, Scotland.

The unanimous decision of the Court essentially confirms the approach of the Upper Tribunal and the division between “structures” and “works involving the alteration of land”. The judgement also emphasises the importance of construing the legislative terms in context.
