Tax Litigation

Members of Chambers appear in all types of tax litigation, both for and against the Government, in all of the tax tribunals and higher Courts of the UK, and in other jurisdictions, as well as in the European Courts of Justice and Human Rights.

Our Members also represent clients in tax-based commercial disputes, professional negligence claims and in all ADR procedures (including arbitration and mediation).  In addition, the senior Members of Chambers have appeared as expert witnesses as to the content of UK tax law in proceedings in other jurisdictions.

We are able to offer a considerable range of litigation experience, and we are able to provide the individual barrister or team of barristers to suit any case. Often the most important cases are determined, on the facts, in the First-tier Tribunal; such cases may require a substantial amount of preparation and a team of one or more QCs and junior barristers. Other cases may turn on a short point of statutory construction and require only a lone QC or junior barrister.  Collectively, our Members of Chambers have a vast experience across the whole spectrum of tax litigation, and the Clerks will endeavour to find the right solution for any given case.

All Members of Chambers have outstanding advocacy skills (both written and oral) combined with the intellectual ability to analyse correctly the often complex issues that arise in tax litigation.  In addition, all of our Members have the advantage of appearing frequently in the UK tax tribunals and higher Courts, and consequently have a very good knowledge of their procedures and ways of working.  We are able to offer practical assistance at all stages of disputes with HMRC.
